The Patient Protection and Affordable Care Act (ACA)

With the passage of the Patient Protection and Affordable Care Act of 2010, starting January 1, 2014, most individuals will be required to have health insurance that provides "Minimum Essential Coverage" or pay a penalty with their tax return. 

Until now, County staff was responsible for determining whether individuals seeking services were eligible for Medi-Cal, and for many the answer was "No". With ACA, this question will be changed to "What will the customer be eligible for?" because nearly everyone will be eligible. 

Key Features of ACA

  • Medi-Cal will be expanded to include those who live in households up to 138% of the Federal Poverty Level (FPL), or approximately $0 - $32,499 for a family of four, using household Modified Adjusted Gross Income (MAGI).
  • Advance Premium Tax Credits (APTC) will be made available for those between 138% and 400% of FPL using MAGI (approximately $32,499 - $94,200 for a family of four).
  • In addition to tax credits, Cost Sharing Reductions (CSR) will be made available for those between 138% and 250% of FPL using MAGI (approximately $35,000 - $60,000).

Enacts a Patient's Bill of Rights including the provisions below

  • Insurance companies cannot turn down patients with Pre-existing conditions
  • Insurance companies cannot cancel coverage if the consumer made an honest mistake
  • No lifetime cap on medical costs, nor annual cap on benefits
  • Insurance companies must justify premium increases and limit administrative charges
  • Young people to age 26 can be covered by their parent's insurance
  • Free preventative care for many services

A person has Minimum Essential Coverage (MEC) if he or she has

  • Any Marketplace plan, or any individual insurance plan you already have
  • Any employer plan (including COBRA), with or without "grandfathered" status. This includes retiree plans
  • Medicare, Medi-Cal (without a Share of Cost [SOC]), the Children's Health Insurance Program (CHIP - previously called TLIC)
  • TRICARE (for current service members and military retirees, their families, and survivors),Veterans health care programs (including the Veterans Health Care Program, VA Civilian Health and Medical Program (CHAMPVA), and Spina Bifida Health Care Benefits Program)Peace Corps Volunteer plans

What kinds of health insurance don't qualify as coverage?

Health plans that don't meet minimum essential coverage do not qualify as coverage in 2014. If you have only these types of coverage, you may have to pay the fee. Examples include:

  • coverage only for vision care or dental care
  • workers' compensation
  • coverage only for a specific disease or condition
  • plans that offer only discounts on medical services

Who doesn't have to pay the fee

Uninsured people won't have to pay a fee if they:

  • Are uninsured for less than 3 months of the year
  • Are determined to have very low income and coverage is considered unaffordable (required contribution exceeds 9.5% of the household income)
  • Are not required to file a tax return because their income is too low
  • Are a member of a federally recognized Indian tribe
  • Participate in a health care sharing ministry
  • Are a member of a recognized religious sect with religious objections to health insurance
  • Incarcerated Individuals
  • Non-Citizens without satisfactory Immigration Status (Undocumented Individuals)

If an individual does not qualify for any of these exemptions, and feels that they have a hardship, they can apply for an exemption asking not to pay a fee. Exemption requests are done through the Covered California Marketplace.
